Understanding Current Immigration Law Under federal and state law, all children—regardless of immigration status—have the right to a free public education. This right is protected by the U.S. Constitution and affirmed by California law. Specifically, the landmark Supreme Court decision Plyler v. Doe (1982) ensures that no child may be denied access to public education based on their immigration status.
Current Immigration Policies Related to Education in California
On October 5, 2017, Governor Jerry Brown signed AB 699 into law. AB699 is a bill designed to enhance protections for immigrant students served by school districts, county offices of education, and charter schools. The bill went into effect January 1, 2018 and contains a number of implications for public schools. In particular, the bill obligated the California Attorney General to publish model policies by April 1, 2018, and for schools to adopt those model policies. At the August 14, 2018 Board Meeting, FSD's Board of Trustees adopted the model policies under Board Policy 5145.13 as required under AB 699.
